Can you afford to phone and drive?

 

Despite the fact that it is illegal to use your mobile phone while driving we all see people who are still doing so.  It was first illegal in December 2003 but back then it only carried a £30 fixed penalty notice which didn’t seem to deter motorists with 75,000 penalty notices being given out in 2004.  From 27th February 2007 the fine was doubled to £60 (rising to up to £1000 should the case be taken to court), it also became an endorsable offence with 3 penalty points also being added to the drivers license.

 

Hands free kits are the only legal way to continue using your mobile phone while driving, however, if a police officer thinks you are driving poorly while using one you can still be charged.

 

Ultimately you are only allowed to use your mobile phone in a device which only requires you to push buttons – if you actually need to hold the device at any point to make the call then it is illegal.

 

The only exemption to the rule is if it’s unsafe for you to stop and pull over to make an emergency call to 999.
